Acceptance of these terms
These terms are an agreement between you and Recoverly. By creating an account, running the free check, or using any part of the service, your use will be treated as acceptance of these terms and of our Privacy Policy. If you do not agree, please do not use Recoverly. How acceptance takes effect is part of the same Texas-attorney review noted below.
You must be at least 18 years old and using Recoverly for a Texas property you own or are buying. Recoverly is offered to Texas homeowners only, for now.
What Recoverly is
What we are: a tax-audit tool, a document preparer, and your certified-mail service. What we are not: a law firm, and not your lawyer. That boundary is the point. It's why you keep 100% of what you recover, one flat fee, never a percentage.
In practical terms, Recoverly checks the tax-proration gap in your Texas new-construction closing, validates the figures you provide, and prepares a demand letter from a fixed template that fills in your details. We do not write custom legal arguments, and we do not decide what is right for your situation.

Your responsibilities
When you use Recoverly, you agree that:
- the figures you enter come from your own Closing Disclosure and property-tax bill, and are accurate to the best of your knowledge,
- you review, approve, and sign every letter before it is sent, and you are the sender of record on any letter that goes out in your name and return address,
- you understand Recoverly never negotiates or communicates with your builder on your behalf, and
- you keep your account credentials secure and are responsible for activity under your account.
If you direct Recoverly to mail a letter for you (currently a Concierge feature; see Fees and refunds below), you are appointing us only for that limited task. Recoverly acts solely as your agent for printing and transmission of the document you approved.
Fees and refunds
The tax-gap check and the full audit are free. If we find a recoverable gap over $50 and you choose to proceed, a recovery package is a flat fee: $99 for the DIY Claim Kit, where you print, sign, and mail the letter yourself. We never take a percentage of what you recover, and there is no subscription.
A $299 Concierge package, where a reviewer re-checks your numbers and Recoverly mails the letter by certified mail as your agent, is described in our materials but is not currently available. Any Concierge terms here apply only if and when we enable it.
For the DIY Claim Kit, you see your recoverable number before you pay, and there is no online signing step: you review, print, sign, and mail the letter yourself. Your fee pays for the check and the prepared letter, not for an outcome.
If and when we enable the $299 Concierge package, that tier carries an accuracy promise, tied to accuracy and never to the outcome of your case:
Our accuracy promise: if we miscalculate your gap from the documents you give us, or you catch a data error before you sign, you pay nothing. The one thing no one can promise is what your builder decides to do.

No guarantee of outcome
Recoverly does not guarantee any particular outcome. Whether your builder agrees to pay, and how much, is the builder's decision and is outside our control. Your fee pays for the check, the prepared letter, and the service described above, not for a result.
Disclaimers and limitation of liability
Recoverly provides the service on an “as is” and “as available” basis. Our documents and information are for self-help purposes and are not legal advice. To the fullest extent permitted by law, Recoverly is not liable for indirect, incidental, or consequential damages arising from your use of the service.
This section, including any limits on liability, is an early draft and is one of the items under Texas-attorney review. We will refine it as that review completes.
Texas scope and governing law
Recoverly is built for Texas property-tax proration recovery and is offered to Texas homeowners only, for now. The service supports Texas property addresses and is not directed to people outside the United States or to children.
These terms are intended to be governed by the laws of the State of Texas. The specific venue and dispute-resolution provisions are under attorney review and will be finalized before Recoverly relies on them.
Changes to these terms
We may update these terms as the service grows and as our attorney review completes. When we make a material change, we will revise the “last updated” date at the top of this page. If you keep using Recoverly after a change, that continued use will be treated as acceptance of the updated terms.
